Liability: In consideration for the Visitor being permitted to use the equipment, resources and facilities provided by North Forge Technology Exchange (herein North Forge Fabrication Lab) or another member or guest at North Forge Fabrication Lab’s premises and to attend at North Forge Fabrication Lab's premises (collectively “Participating in North Forge Fabrication Lab): The Visitor acknowledges that inherent risks, dangers and hazards exist when using hand tools, power tools, working with or constructing electronic circuits, soldering, welding or otherwise working with metal, using chemicals or building materials, fabrication, software design and other related and technology related activities. Participation in these activities and the use of equipment associated with electronics, manufacturing, construction and scientific practices may result in injury, illness, death or damage to personal property. These risks and dangers may be caused by the Visitor, members or their guests, by accident, acts of nature or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes, which risks and dangers may include, but are not limited to, electrocution, burns, impalement, injury from slips or falls, or loss of limb. The Visitor fully assumes all risks associated with participating in North Forge Fabrication Lab and exempts and releases North Forge Fabrication Lab its members, officers, agents and directors and their respective heirs, executors, administrators, personal representatives and assigns, from liability arising out of any damage, loss or injury to the Visitor or the Visitor’s property while participating in North Forge Fabrication Lab, whether such loss, damage, or injury results from the negligence of North Forge Fabrication Lab, its members, officers, agents, directors, guests of members, or from some other cause. The Visitor agrees never to institute any suit or action at law otherwise against North Forge Fabrication Lab, its members, officers, agents and directors and their respective heirs, executors, administrators, personal representatives and assigns, nor to initiate or in any way assist the prosecution of any claim for damages or course of action which the Visitor, Visitor’s heirs, executors, administrators, personal representatives or assigns, hereafter may have by reason of injury to the person of the Visitor or to the Visitor’s property arising from Participating in North Forge Fabrication Lab. The Visitor will indemnify, save and hold harmless North Forge Fabrication Lab, its members, officers, agents and directors and their respective heirs, executors, administrators, personal representatives and assigns, from any and all losses, claims, actions, or proceedings of every kind and character which may be presented or initiated by any other persons or organizations and which arise directly or indirectly from the actions of the Visitor while participating in North Forge Fabrication Lab. North Forge Fabrication Lab provides the Visitor with the opportunity to participate in North Forge Fabrication Lab “as is”, as a service, and not as a lease of real property, and disclaims all warranties and conditions, whether express, implied or statutory, including, but not limited to, merchantability, or fitness for a particular purpose or use. There is also no warranty of title, quiet enjoyment or possession. The entire risk of participating in North Forge Fabrication Lab remains with the Visitor. By signing this visitor form, North Forge Fabrication Lab and the Visitor indicate acceptance, of the terms and conditions set out above.
